JDCELEARN Engineering Review App Terms and Conditions

1. Introduction

Welcome to JDCE Learning Hub (“JDCELEARN,” “the App,” “we,” “our,” or “us”), a duly registered business entity under the laws of the Republic of the Philippines, with principal address at Casa Mira Towers, Guadalupe.

JDCELEARN is designed to supplement the learning of Civil Engineering students and strengthen their preparation for the Civil Engineering Board Examination through educational resources authored and curated by Engr. Jobert S. De La Cruz. These resources include, but are not limited to, pre-recorded video lectures, mock examinations, downloadable review materials, and other digital learning resources.

For purposes of these Terms and Conditions, any individual who accesses, registers for, or uses JDCELEARN’s services shall be referred to as the “User,” “you,” or “your.”

These Terms and Conditions (“Agreement” or “Terms”) constitute a legally binding agreement between JDCE Learning Hub (“JDCELEARN”), a duly registered business entity under the laws of the Republic of the Philippines with principal address at Casa Mira Towers, Guadalupe, and you. This Agreement governs your access to and use of JDCELEARN’s website, mobile applications, educational materials, digital content, and related services (collectively, the “Services”).

By accessing, browsing, registering for, subscribing to, or otherwise using the Services, you acknowledge that you have read, understood, and voluntarily agree to be legally bound by these Terms and Conditions.

We may update or modify these Terms from time to time. You will be provided with prior notice of any scheduled changes to the Services you are using. Unless otherwise stated, changes to these Terms will take effect ten (10) days after notice is given. However, updates relating to new features, security enhancements, or bug fixes will take effect immediately upon release.

By continuing to use the Services after the effective date of any changes, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you may discontinue your use of the Services in accordance with Section 16, “Term and Termination,” below.

You must be at least 18 years old to use JDCELearn. If you are under 18, you may only use the Services with the consent and supervision of a parent or legal guardian.

For your reference, we recommend that you save or print a copy of these Terms and Conditions for your personal records.

2. Our Services

The information and content provided through the Services are intended solely for users in jurisdictions where such access and use are legally permitted. The Services are not intended for distribution to, or use by, any person or entity in any country or jurisdiction where such distribution or use would be contrary to law or regulation, or which would subject JDCELearn to any registration, licensing, or other legal requirements.

Individuals who choose to access the Services from locations outside of our intended jurisdiction do so on their own initiative and are solely responsible for ensuring compliance with all applicable local laws and regulations.

3. Intellectual Property

a. Our Intellectual Property

Any copying, recording, reproduction, distribution, modification, or public display of the Content, in whole or in part, without the prior written consent of JDCELearn, is strictly prohibited and may result in legal action, as well as suspension or termination of access to the Service.

b. Use of Service

Subject to your compliance with these Legal Terms, including the “Prohibited Activities” section below, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services; download or print portions of the Content that are expressly made available for download; and use such Content solely for your personal, non-commercial educational purposes.

Except as expressly permitted above, no part of the Services or Content may be copied, reproduced, modified, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our prior written consent.

Any violation of these intellectual property rights will be deemed a material breach of these Legal Terms and will result in the immediate termination of your right to use the Services.

c. Your Submissions and Contributions

By submitting any questions, comments, suggestions, ideas, feedback, or other information regarding the Services (“Submissions”), you hereby assign to us all intellectual property rights in such Submissions. We may use, reproduce, modify, adapt, publish, distribute, or otherwise exploit them for any lawful purpose, commercial or otherwise, without acknowledgment, notice, or compensation to you.

The Services may allow you to participate in interactive features such as chats, blogs, message boards, community hubs, forums, or similar platforms (“Contributions”). Contributions may include text, writings, videos, audio recordings, photographs, graphics, comments, reviews, ratings, suggestions, personal information, or other materials that you create, submit, post, display, transmit, publish, or distribute through the Services.

By posting or submitting Contributions, you grant JDCELearn a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and otherwise make your Contributions available in connection with the operation, promotion, and improvement of the Services.

You retain ownership of any intellectual property rights in your Contributions. However, once Contributions are made publicly available through the Services, we cannot control how other users may use or share them, and we are not responsible for any misuse by third parties.

We reserve the right, but not the obligation, to monitor, review, screen, edit, or remove any Contributions at our sole discretion, without prior notice, if we believe they violate these Terms, infringe on intellectual property rights, or are otherwise harmful, offensive, unlawful, or inappropriate.

d. Copyright Infringement

By posting or uploading Contributions, you represent and warrant that you own or have obtained the necessary rights, licenses, or permissions to share such materials, and that your Contributions do not infringe on any third-party copyrights, trademarks, or other intellectual property rights.

If you believe that any material on JDCELearn infringes your copyright, you may notify us by contacting delacruzengineering@gmail.com with sufficient details to identify the copyrighted work and the allegedly infringing material.

4. User Representation

By using the JDCELearn website or app, you represent and warrant that:

If you provide false, inaccurate, outdated, incomplete, or misleading information, misrepresent your identity, student or reviewee status, licensure status, or affiliation, or otherwise breach any of the representations above, JDCELearn reserves the right to verify your information, suspend or terminate your account, cancel your subscription, deny or revoke access to the Services, and take appropriate legal action when necessary.

5. User Registration and Access

a. Registration and Login

To use the JDCELEARN app, you must first register through jdcelearn.com, select your desired course, and complete all registration requirements. Once your registration has been reviewed and approved, you will receive a confirmation email. You may log in to the JDCELearn app only after your registration has been approved.

b. Account Responsibility

You are solely responsible for maintaining the confidentiality and security of your account credentials, as well as for all activities conducted under your account. JDCELearn shall not be held liable for any unauthorized access, use, or account compromise resulting from your failure to safeguard your login information.

d. Right to Refuse, Suspend, or Terminate Registration

JDCELearn reserves the right, at its sole discretion, to refuse, reject, suspend, or terminate any registration, subscription, or account access if the applicant or user is found to be, or is reasonably believed to be, using the Services for purposes inconsistent with the platform’s intended educational use.

This may include individuals who are board examination passers, instructors, lecturers, reviewers, owners, staff, representatives, or affiliates of other review centers, institutions, or similar organizations, especially where access may result in unauthorized use, copying, reproduction, distribution, competition, or misuse of JDCELearn’s materials, videos, teaching methods, platform content, or proprietary resources.

6. Fees, Processing, and Subscription Access

All payments for JDCELearn app subscriptions must be made only through the official JDCELEARN website at jdcelearn.com. If you encounter issues with payment, you may contact us through our official Facebook page: JDCELEARN - Engineering Review App.

JDCELearn reserves the right to verify and confirm all payments before approving or activating any subscription, course access, or user account.

a. Subscription Access and Validity

JDCELEARN course access is valid only within the active subscription period selected or paid for by the User. Upon expiration, cancellation, non-renewal, or failed payment, access to enrolled courses, learning materials, and other subscription-based content may be suspended, restricted, or terminated.

Any unused access, unviewed materials, or unclaimed benefits shall not be carried over beyond the subscription period. It is the User’s responsibility to use the Services within the active subscription period and to immediately report access, login, payment, or technical concerns during such period.

b. Courtesy Access, Extensions, and Special Grants

Any courtesy access, extension, special access, complimentary access, or similar grant provided by JDCELEARN shall be considered a discretionary accommodation and not a guaranteed right of the User. Such grants are valid only during the specific period, review season, subscription period, or timeframe for which they were offered or approved.

Courtesy access, extensions, or special grants shall not be automatically carried over, renewed, converted into cash, or applied to a future subscription period, review period, or examination cycle.

c. Refund Policy

All payments are final and non-refundable, except where required by applicable law or as otherwise determined by JDCELEARN. A refund may be considered only if the user is unable to properly access or use the JDCELEARN app due to a verified issue attributable to the platform, and only after JDCELEARN has been given a reasonable opportunity to assess and resolve the issue.

Since JDCELEARN operates on a monthly subscription basis, any portion of the subscription month that has already begun or been used shall be considered consumed. Refund approval shall be at the sole discretion of JDCELEARN, subject to applicable laws and regulations.

d. Price Changes

Course subscription rates may be adjusted at any time at the sole discretion of JDCELEARN. Any changes in pricing may be communicated through official announcements, including the JDCELEARN website, app, community channels, Facebook page, or other authorized communication channels.

7. Prohibited Use of Paid Content

The unauthorized distribution, resale, sharing, screen recording, or reproduction of JDCELEARN content, including but not limited to video lectures, mock exams, and community resources, is strictly prohibited. Any such violation may result in immediate suspension or termination of access without refund and/or legal action for infringement of intellectual property rights.

8. Prohibited Activities

When using the JDCELearn website or app, you agree not to engage in account misuse, misuse of content, inappropriate or unlawful conduct, security violations, intellectual property violations, automated or unauthorized data collection, or any conduct that violates applicable laws, regulations, or academic integrity standards.

Violations may include sharing or selling account credentials, impersonation, copying or recording content without authorization, using content for commercial or competitive purposes, harassment, cheating, introducing harmful code, scraping, harvesting user data, or posting infringing material.

9. Consequences of Violations

Violations of these Terms may result in the suspension or termination of your account, removal of offending content, and/or legal action where applicable. Repeat or severe violations may result in a permanent ban from the Services without refund.

10. Watermarking and Protection of Learning Materials

For the security and protection of JDCELEARN’s learning materials, videos, downloadable files, documents, and other course content may contain visible or invisible watermarks, including but not limited to the user’s registered email address, account details, or other identifying information.

These watermarks are used to help protect JDCELEARN’s intellectual property, prevent unauthorized copying, sharing, recording, reproduction, distribution, resale, uploading, or misuse of course materials, and identify the source of any unauthorized disclosure or breach.

You are solely responsible for safeguarding all learning materials accessed through your account. Any unauthorized sharing, distribution, posting, reproduction, screen recording, downloading, resale, or disclosure of watermarked materials traced to your account may be considered a violation of these Terms.

11. Guidelines for Reviews

We may provide areas within the Services where you can leave reviews or ratings. Reviews must be based on firsthand experience, truthful, relevant, not misleading, and must not contain profanity, abusive, racist, offensive, hateful, or discriminatory language.

12. Service Management

We reserve the right, but not the obligation, to monitor and moderate the Services, restrict or suspend access, maintain platform integrity, manage availability, and enforce rights against users who violate these Terms or misuse JDCELearn content.

13. Privacy Policy

Your use of the JDCELearn website and app is subject to our Privacy Policy, which explains how we collect, use, store, and protect your personal information. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.

The Services are hosted in the Philippines. If you access the Services from another region, you acknowledge and agree that your data will be transferred to, and processed in, the Philippines, and you expressly consent to such transfer and processing.

14. Copyright Infringements

We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content available on or through the Services infringes your copyright, please notify us immediately using the contact information below with sufficient detail to identify the copyrighted work and the allegedly infringing material.

15. Term and Termination

These Terms remain in full force and effect for as long as you use the Services. You may terminate your access at any time by deleting your account through the Account tab in the JDCELearn App. Account deletion is permanent and irreversible, except as may be required or permitted by applicable law.

We reserve the right, in our sole discretion, to suspend or permanently terminate your account and access without notice if you violate these Terms, fail to meet User Representations, misuse intellectual property, compromise the Services, or if required by law.

Upon termination or expiration of your membership, your license to access and use JDCELearn Services will immediately end, access to premium content and features will be revoked, and no refunds or credits will be provided for any unused portion of your membership.

16. Modification and Interruptions

JDCELEARN reserves the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice. We make no guarantees regarding continuous availability or uninterrupted access. Temporary interruptions may occur due to maintenance, updates, or technical issues.

17. Limitation of Liability

JDCELEARN provides educational content as a learning aid but does not guarantee exam results, licensing success, or professional outcomes. To the fullest extent permitted by law, JDCELEARN is not liable for indirect, incidental, or consequential damages arising from your use of the Services.

18. Changes to Terms

JDCELearn reserves the right to modify these Terms at any time. Any such modifications shall become effective upon posting. Continued use of the Services after the effective date of the revised Terms shall constitute your acceptance of and agreement to be bound by those Terms.

19. Disclaimer

The Services are offered on an “as is” and “as available” basis without warranties of any kind. JDCELearn does not guarantee that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that content will be accurate, complete, or reliable.

20. Indemnification

You agree to indemnify, defend, and hold harmless JDCELEARN, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses arising out of your access to or use of the Services, violation of these Terms, or infringement of any third party’s rights.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the proper courts of Mandaue City, Cebu, Philippines.

22. Miscellaneous

These Terms, together with any policies or operating rules posted by us on or in connection with the Services, constitute the entire agreement and understanding between you and JDCELEARN. If any provision is found unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
